Karnataka High Court Ruling Reinforces Need for Stringent Procedures in Graft Investigations

In a landmark verdict, the Karnataka High Court has underscored the vital importance of procedural integrity in criminal investigations, particularly regarding the use of private forensic reports. The court dismissed charges against a public servant in a graft case under the Prevention of Corruption Act, citing multiple investigative lapses that jeopardized the rights of the accused.

The case revolved around allegations that the public servant demanded a bribe of Rs. 5,000 to facilitate the release of a seized vehicle. The Lokayukta Police initiated an investigation based on the complaint, including a recorded conversation between the complainant and the accused. This audio was sent to Truth Labs, a private forensic agency, for analysis. However, the High Court identified significant procedural flaws in the investigation that led to the charges being dismissed.

Justice V. Srishananda pointed out that the Lokayukta Police overstepped their jurisdiction by taking charge of a case that should have been handled by local police in Chikkaballapura. Moreover, the court criticized the decision to refer the voice sample to a private lab instead of the government Forensic Science Laboratory, arguing that reliance on private analysis without proper validation undermined the credibility of the evidence.

The court emphasized that accepting a private lab’s report as “gospel truth” without government oversight could violate the accused’s rights, potentially leading to a miscarriage of justice. This ruling sets a critical precedent, raising questions about the role of private forensic agencies in legal proceedings. It serves as a clarion call for law enforcement to adhere strictly to proper protocols to protect the integrity of the judicial process and the rights of all individuals involved.
