Supreme Court Upholds FIRs Against Former CBI Officials
On Wednesday, the Supreme Court validated a Delhi High Court’s directive to file First Information Reports (FIRs) against Neeraj Kumar, a former Joint Director of the Central Bureau of Investigation (CBI), and Inspector Vinod Kumar Pandey. This unprecedented ruling highlights alleged misconduct stemming from incidents that occurred two decades ago, with the bench emphasizing that scrutiny is essential to maintain public trust in judicial processes.
The Authority of the Law
Justices Pankaj Mithal and P.B. Varale of the Supreme Court made it clear that no individual, regardless of their official status, is exempt from criminal investigation. This ruling marks a significant moment, occurring 25 years post-incident, illustrating the judiciary’s firm commitment to accountability within law enforcement.
Allegations of Coercive Behavior
The case centers around complaints filed by Vijay Aggarwal and Sheesh Ram Saini. Both individuals accused the officers of serious misconduct, including coercion and intimidation. Aggarwal claimed he was subjected to threats and abusive behavior to discourage him from pursuing a complaint his brother had lodged against Kumar. Saini similarly alleged that the officers overstepped their authority during the process of document seizures.
In 2006, the High Court remarked on the gravity of these allegations, indicating that they indicated potential cognizable offenses under the Indian Penal Code. Despite a preliminary inquiry by the CBI finding no wrongdoing, the High Court still insisted that the serious nature of the claims warranted thorough investigation.
The Principle of Accountability
By siding with the High Court’s earlier decision, the Supreme Court underscored the essential nature of accountability in the justice system. Justice Mithal articulated that ignoring such offenses would create a hypocrisy in justice, especially when the allegations involve officers tasked with maintaining law and order.

The Delhi High Court had previously directed the Special Cell of the Delhi Police to oversee the investigation. The Supreme Court, however, specified that this inquiry should be conducted by an officer at least of Assistant Commissioner rank. This decision aims to reinforce the investigation’s integrity while preserving the balance of institutional oversight.
This ruling marks a significant shift for Neeraj Kumar and Vinod Kumar Pandey. Kumar, who ascended to the role of Delhi Police Commissioner before retiring in 2013, now faces a complex legal predicament.
